Medicaid Estate Recovery

For Nebraska residents participating in the Enable Savings Plan, Enable accounts are not subject to 529A claims against the beneficiary of a Enable account for total medical assistance paid after the establishment of an account by the Nebraska Department of Health and Human Services pursuant to Nebraska Statute 77-1403(5). However, the Nebraska Department of Health and Human Services may recover payments from the estate of Medicaid beneficiaries as required by Section 1917(b) of the Social Security Act. Those impacted will be the estates of individuals who received medical assistance from the Nebraska Medicaid Program after the age of 55 and those individuals who resided at a medical institution at the time of application for medical assistance.
